                            2. DEFINITIONS

                            In these conditions the following words have the following meanings:

                            • “order” means a contract to purchase product or services.
                            • “you” means the person, firm, company, entity or other organisation looking to purchasing product.
                            • “deposit” means any advance payment required by ourselves in relation to the purchase of product.
                            • “liability” means liability for any and all damages, claims, proceedings, actions, awards, expenses, costs and any other losses and/or liabilities.
                              “product” means the product or products available for sale.
                            • “we” means Leisureline Spas ( trading under the legal entity of ONE 4 ALL HIRE LTD.) and includes its employees, servants, agents, operatives and/or duly authorised representatives.
                            • “services” means the services and/or work (if any) to be performed by ourselves for you in conjunction with the sale of products including any delivery and/or collection service for product.

                            3. BASIS OF CONTRACT

                            3.1 Products are available via our web site or through our designated retail outlets, and are subject to terms and conditions as detailed on this web site.
                            3.2 All product is subject to availability.
                            3.3 We reserve the right to change prices and specifications without notice.
                            3.3 Nothing in this Contract shall exclude or limit any of your statutory rights.

                            4. PRICES

                            1.Prices quoted throughout our web site or contained within our catalogues or brochures are unless otherwise stated inclusive of VAT at the applicable rate.
                            On larger items such as spas or saunas there may be associated handling costs and customers are advised to seek advice before placing orders on this shop.

                            2.Any special offers that are related to the Customer receiving additional items or services are  based on the Customer paying the full RRP of the product/s. Certain offers may be revised/withdrawn at the discretion of Leisureline Spas.

                            5. PAYMENT TYPES

                            We accept payments for Products or Services from the following cards - American Express, Visa, Visa Electron, MasterCard (excluding Maestro), Switch (including Solo) and JCB

                            We also accept Credit Card Cheque or with prior agreement via cash, personal cheque with current bankers card.

                             6. PAYMENT TERMS

                            This on line shop requires you to pay for the the goods at the checkout process via any of the offered payment gateways.

                            7. PRODUCT AVAILABILTY

                            Although we take great effort to ensure availability of product there are inevitably times when products are unavailable for whatever reason.
                            To safeguard you against transacting for goods that are out of stock we will in all cases only process your order once we have confirmed availability.
                            If the product is out of stock or on long lead time then we will notify you of this.
                            If you choose to proceed with the order based on this delivery information then we shall transact and process your order.

                            8. ORDER PLACING METHOD

                            8.1 OUR ON LINE SHOP
                            The order form accessed via our web site is the preferred option for order placement. Please fill out the required fields and follow the on screen instructions.
                            There may be some information missing or there may be details pertaining to delivery that require prior consent from you. Please process the form as best you can and upon receipt of the order from you we will check all aspects including availability and in all cases we will contact you to confirm the order details and point out any changes or amendments that need your approval.
                            Once you have agreed this then the order will be processed and the payment transacted

                            8.10 TELEPHONE ORDER
                            To order by phone contact us on 01952 810168 and have your card details ready. We will guide you through the order process.

                            8.11 FAX
                            To order by FAX dial 01952 810168. If the order is from a credit account holder then the order must be on the appropriate headed paper and your internal order no and authorised signature must be annotated.

                            8.12 EMAIL
                            We do not accept orders via email but we will respond to order enquiries via email

                            9. CHANGES TO DELIVERY SCHEDULE

                            9.1 Should any changes to the delivery schedule become known to us then we shall communicate those changes to you as quickly as possible.

                            9.2 Although we make all efforts to give realistic delivery dates and avoid delays in delivery we accept no liability for delays caused by circumstances that are beyond our control.

                            9.3 Where product is sourced overseas the Shipping Agents and Customs clearance processes can be subject to delays particularly at times of capacity constraint such as Christmas.

                            10. ORDER CANCELLATION

                            10.1 If you wish to cancel the order then we shall assess the situation with our Suppliers and if the product can be allocated to another customer or outlet then we shall offer this solution to you. However should this be an alternative then there would be a charge for handling costs and administration fees. In the event that the product is deemed customised to you thus limiting the opportunity for re sale then we reserve the right to reject the cancellation request.
                            In any event requests for cancellation must be received in writing within 30 days of the date of collection or delivery.

                            10.2 If you wish to cancel the order due to a problem with merchant quality of the product and where we have not been able to repair or replace within reasonable time then again we must receive your request in writing within 30 days of the date of collection or delivery.

                            10.3 If a cancellation is agreed, you must return the goods to us at your cost unless the goods are being returned because they are faulty, incorrect goods or because of unsuitable substitution by us, in which case we will meet the cost of return. In this case we will nominate the carrier.

                            11. DELIVERY & TITLE

                            11.1 Unless instructed accordingly we will deliver the product in accordance with your order. A valid signature will be required on collection or delivery. Immediately prior to despatch of the product to you, title in the product will pass to you.In the event that you have not received all the goods within 21 days of the date of delivery you must notify us immediately.

                            12. ON SITE SERVICES

                            12.1 For larger product such as spas, saunas etc we shall require sufficient access to the installation area and you need to be aware that any additional handling costs such as crane hire etc that may be necessary shall be your responsibility. Such costs shall be payable prior to completion of the service.

                            12.2 You will be solely responsible for any damages caused as a result of giving instructions to any of our agents or operatives except to the extent that the persons performing the services are negligent.

                            12.3 If any Services are delayed, postponed and/or are cancelled due to you failing to comply with its obligations. You will be liable to pay additional charges unless the delay is due to Force Majeure.

                            13. LIABILITY

                            If you have notified us of a problem with the goods, we may elect to either make good any shortage or non-delivery; replace or repair any goods that are damaged or defective upon delivery; or refund to you the amount paid by you for the goods in question.

                            We will not be liable to you for any loss of profits, administrative inconvenience, disappointment, indirect or consequential loss or damage arising out of any problem in relation to the goods and we shall have no liability to pay any money to you by way of compensation other than any refund we make under these conditions.
                            This does not affect your statutory rights as a consumer, nor is it intended to exclude our liability to you for fraudulent misrepresentation or for death or personal injury resulting from our negligence.

                            14. FORCE MAJEURE

                            We shall have no liability to you for any failure or delay in supply or delivery or for any damage or defect to goods supplied or delivered under circumstances outside of reasonable control, including but not limited to acts of God, war, flood, fire, labour disputes, strikes, sub-contractors, importation delays, lock-outs, riots, civil commotion, malicious damage, explosion, terrorism, governmental actions and any other similar events.

                            15. TERMINATION OF CONTRACT

                            We reserve the right to suspend supply or delivery, stop any product in transit or terminate our contract by notice in writing to you if you are in material breach to our terms and conditions.
                            Should you become unable to pay your debts when they fall due or proceedings are commenced by or against you alleging bankruptcy or insolvency. Upon termination, your indebtedness to us becomes immediately due and payable and we shall be under no further obligation to supply goods to you.

                            16. GOVERNING LAW

                            This Contract is governed by and interpreted in accordance with English law and the parties agree to submit to the non-exclusive jurisdiction of the English courts.

                            17. DISCLAIMERS

                            17.1. Images contained within advertising brochures or the web site are for illustration purposes only; We reserve the right to change without notice.

                            17.2 Colours and specifications may vary from those depicted.

                            17.3 We reserve the right to amend pricing at our own discretion.

                            17.4 We shall make all efforts to avoid omissions or mistakes contained within this web site, however such errors may occur from time to time and these shall be remedied without liability.

                            17.5. We accept no liability for material damage or adverse effects to computer equipment or data by using this web site or any links contained within this web site.

                            17.6 Customers electing to finance their purchase through Leisureline Spas appointed schemes are not eligible for any of the special offer deals or discounts and finance will be calculated on the products full RRP.  Any concessions to this are at the sole discretion of Leisureline Spas. Customers using their own finance schemes are eligible for all other discounts, and offers as offered by Leisureline Spas.

                             18. PRIVACY & DATA SECURITY POLICY

                            18.1. We shall not disclose to any third parties information or particulars relating to your details.

                            18.2. Data pertaining to you shall only be retained for the purpose of accounting and shall be in compliance with accounting practices.

                            18.3. We shall keep you personally informed of new products & services only if the pre requisite acceptance box on the enquiry/order form has been annotated, or if requested via the companies web site or brochure material.

                            19. COMPLAINTS PROCEDURE

                            In the first instance, should you require to register any complaints about the product or services, then please contact us via one or more of the following methods;

                            Please  clearly state the nature of the complaint.
                            We shall in all cases seek to mutually resolve any complaints with 15 working days upon receipt.

                            20. SPA SCRAPPAGE SCHEME
                            1.  Maximum trade in value is £1,000.
                            2.  Allowance is against selected spas – Leisureline Spas reserves the right to vary the spa models on offer.
                            3.  Trade in spa can be in working condition or not
                            4.  Inflatable spas are allowed within the scheme.
                            5.  This offer cannot be used in conjunction with any other offers currently in progress either via web site or the retail shop.
                            6.  Only one trade in spa allowed per customer
                            7.  The scrappage allowance is subject to site survey and assumes easy access and removal by our standard trolley system.
                            8.  A charge for site surveys may be requested in advance depending on travel distance – Any amount paid for the site survey would be redeemable against a spa purchase, less any fuel-incurred costs.
                            9.   The order must be received and processed for payment prior to the scheme end date.
                            10. Leisureline Spas reserve the right to refuse any application request
                            11. Payment terms acceptable are as follows:

                            d.      Credit Card –Incurs merchant banking fees typically 1.9%

                            21. PRIVILEDGE CARD

                            1.To obtain a Priviledge Card  complete either the on-line or In-store application form.

                            2.The card has no monetary value.

                            3.On-Line use:

                            • The card can be used to obtain 10% discounts on chemicals and filters (excluding postage and packing) ordered on-line.

                            4. In Store use

                            • The card can be used to obtain offers such as "Buy one get one Free" or "3 for 2" offers In-store.
                            • Spend excluded already discounted offers wil be rewarded as shown In - store.

                            5. Monthly Prize Draw

                            • Priviledge card numbers will be entered into a monthy draw commencing May 2010
                            • Information reagarding monthly prize and winning number will be available In -store

                            6. Leisureline Spas reserve the right to make changes or withdraw offers without notice.

                            22 . Spa-N-A-Box Warranty Details

                            Somerset Hot Tubs are the official Comfortline Products warranty repairer for the UK

                            Warranty

                            The Spa-N-A-Box & Spa2Go are covered by a 1 year limited parts Return to base warranty.

                            All warranty claims must be made to Somerset Hot Tubs on 01934 412320.

                            The warranty conditions are as follows;

                            1. Day 1-30

                            Within the first 30 days of purchases if there is any failure with the spa the customer needs to call Somerset Hot Tubs on 01934 412320 or email info@spa-n-a-box-clp.co.uk to file a claim. The customer must have proof of purchase from the retailer and the spa serial number (found on your invoice or power pack unit of the spa) in order to verify the claim. Phone lines are open between 10:00-17:00 Monday to Friday.

                            Once the claim is verified the customer will be sent within 3 working days a like new item and a call tag will be issued for the defective item. Within the first 30 days of purchase the customer will not be charged anything for delivery or collection of the faulty part. A defective power pack must be returned to Somerset Hot Tubs within 10 working days of delivery of the replacement. Failure to return the power pack within allotted time will result in a charge for the new power pack.

                            2. Days 30-90

                            If there is any failure with the spa after the 30 day period the customer will need to verify the claim with Somerset Hot Tubs on 01934 412320 or email info@spa-n-a-box-clp.co.uk as in (1). The customer will be charged a £45.00 service charge to cover the cost of processing, delivery, and collection of the replacement item. A replacement item will be dispatched to the customer within 3 working days, power packs must be returned to Somerset Hot Tubs as 1 above.

                            3. Second fault within Days 30-90

                            If within 90 days of repair the unit should have another similar fault the customer will not have to pay another service charge.

                            4. After 90 days

                            After the 90 day period any faults are again liable to a £45.00 service charge to cover the collection and return delivery of the defective item following repair. Faults must be reported to Somerset Hot Tubs on 01934 412320 or email info@spa-n-a-box-clp.co.uk . Proof of purchase must be provided along with the power pack serial number as in (1) above.

                            Proper water chemistry must be maintained at all times, PH must be kept between 7.2 –- 7.6ppm and water hardness between 150 - 300ppm

                            The UK warranty is valid for one year from date of delivery within the UK only. All warranty claims should be filed with the Somerset Hot Tubs on 01934 412320 or email info@spa-n-a-box-clp.co.uk

                            The warranty is null and void if the Spa-N-A-Box or Spa2Go are used for commercial purposes
